Higher court: Raonic illegally re-elected as general director of RTCG

The Higher Court in Podgorica confirmed the decision of the Basic Court according to which Boris Raonic was illegally re-elected as the General Director of the Public Service, ETV portal learns.

This confirmed that the RTCG Council did not implement the previous final ruling on the illegal election of Raonic from 2021.

The second-instance verdict was handed down by a panel composed of the president, judge Milorad Marotić and members Marko Blagojević and Marija Bošković, and following a lawsuit by Srđan Čović who sued the Public Service for the illegal appointment of Raonic on June 1, 2023.

This is the second second-instance verdict according to which Raonic was illegally appointed as general manager in June of last year.

The court, ruling on the lawsuit of Nikola Marković, issued a verdict in April which annulled as illegal the RTCG's decision to appoint Raonic.

In the judgment of April 30, based on the lawsuit of Čović, the Basic Court stated, and the Higher Court confirmed, that the contested decision on the appointment of Raonic does not contain an explanation of which criteria prevailed in his favor, compared to the other candidates.

- ... Despite the indisputable fact that Council members have discretionary powers to choose between candidates who meet the conditions, there must be clear criteria and reasons for their decisions that determine support for one of the candidates - the verdict said.

Among other things, the court stated that Boris Raonic, on the day of the announcement of the competition in June 2021, and on August 6 of the same year when he was elected as a director, did not meet the requirements regarding work experience, in accordance with Article 50 of the Law on Public to the broadcaster.

The court found that Raonic graduated from the Faculty of Law in 2018, and that it is clear that he did not meet the requirement for ten years of work experience in qualification level VII1 of the education level.
