Mrvaljević: An obvious example of abuse of official position through abuse of a state body

The executive director of the NGO "Luča" Nebojša Mrvaljević told Pobjeda that it is clear from the police actions on Thursday and Friday that the outgoing Prime Minister Dritan Abazović "does not understand or will not accept that the state, law and order, and the tranquility of citizens are defended by legal means."
The actions of the security services must be based on the law, clearly framed by rules and procedures. He repeated several times, and this could also be heard from the Minister of Interior and Defense, that "one should not strictly adhere to the law", "that the laws are poorly written" and put themselves in a position to interpret and implement them in the way they think is right - explains Mrvaljević.
Pobjeda's interlocutor was an employee of the Police Directorate for years and points out that based on publicly available information in the media and on social networks, it is unequivocally clear that the police action on Thursday "was anything but that".
The operational information that was acted upon is primarily information about a possible attack - endangering the life and body of a person by using an explosive device. And this operational information is problematic from the perspective of operational analysis. The question of the reliability of the source, the question of accuracy or probability, and the question of possible consequences. A source known to the police gives information that is not directly confirmed, but is knowledge from a third party that is not verifiable! There is no or no confirmation of information from other sources available! Everything points to a lower level of probability - he explains.
Because of all this, according to our interlocutor, it can be reasonably suspected that this information was faked, "with the aim of skipping the legal obligation to have a search warrant issued by the competent authority".
Thus, PTJ was used to search the premises of Hotel "Podgorica" and the building next to it, probably deeply believing that compromising material would be found. The result of the action was humiliating for both the principals and the executors - he adds.
And yesterday's police raid in these facilities, Mrvaljević says, is controversial, "absolutely illegal".
They completely forgot that the raid is an operational-tactical action that is part of a wider activity - an action for which there is an operational plan. That plan must be approved by someone, must have prior operational research, must define all activities by time, place and executors. A special part of the plan should be measures of communication with the public - explains our interlocutor.
It is clear, he points out, that the prosecutor's office is excluded from the activities carried out and that they were carried out only on the basis of the authorizations given by the Law on Internal Affairs, and not by the Code of Criminal Procedure".
The behavior of the police officers themselves is contrary to the defined procedures. There is no warning about what it is about, there is no clear order to those present on how to act, there is no communication with an authorized person! Face-locking - immobilization for no clear reason, getting into verbal arguments, unjustified hitting of people who acted according to orders, returning one police officer to discuss "something" with one of the guests and the behavior of the other policemen who aggressively rushed... At the moment, it resembled the Martinović case that took place on the Millennium Bridge several years ago - emphasized Mrvaljević.
He believes that it is necessary to involve the prosecutor's office, if necessary, and the Special Prosecutor, as well as the disciplinary prosecutor of the MUP, the Ethics Committee of the Police Administration, the Council for Citizen Control of Police Work, as well as the non-governmental sector and the media.
This is an obvious example of abuse of official position through abuse of a state body and as such very dangerous for the overall security situation in society. The reaction must be quick and clear! There is no excuse for illegal behavior regardless of the motive. And in my opinion, it is clear - the personal and group political benefit of the outgoing prime minister - concluded Mrvaljević.
