The capital city of Cetinje filed a lawsuit against Miroljub Petrović from Leskovac and the "Pleme Kuči" Association for violating the personality rights of a legal entity in the "Heart of Serbia" video.
The lawsuit was prepared by the legal team of Prijestonica headed by lawyer Vid Đakonović, it was announced from the Public Relations Office in the office of the Mayor of Cetinje.
The "Heart of Serbia" video was released on August 20, 2024, and was filmed in the most recognizable and attractive locations on the territory of the capital.
The lawsuit alleges that the defendants caused damage to the Capital City by openly challenging its identity, by illegally commercializing the Capital City's symbols, and by attributing its heritage and heritage to another state.
"The audio and visual content of the recorded material are in complete contradiction, and the mentioned segments were combined in an extremely malicious and perfidious manner, with the obvious intention of trying to nullify the existence of the Capital, its specificity and identity determinants, as well as cultural-historical heritage and centuries-old tradition; the heritage of the Capital is attributed to another state, and the Capital and localities on its territory are trying to present themselves as an integral part of the Republic of Serbia. Namely, while the text of the song (which is indicated by the very title - "Heart of Serbia") explicitly talks about another country - Serbia, the video content shows shots of the natural and cultural heritage of the Capital City", the lawsuit states.
It is pointed out that the defendant has grossly misused the cultural assets by which the Capital is recognizable, and that, among other things, it did not provide the necessary consent of the Capital and the approval of the competent Administration for filming in the territory of Cetinje.
"It is evident that the defendant has undertaken a whole series of actions that: deny the identity of the Capital and its heritage, as well as its belonging to Montenegro in the territorial, national, historical and cultural sense; attributes the main cultural and historical features of the Capital to a foreign country; misuses the most characteristic and valuable symbols of the Capital for the purpose of promoting its own nationalist propaganda and inciting tensions; illegally and without authorization commercializes the heritage of the Capital; offends the feelings of the citizens of Prijestonica and tells untruths about the participation of the local government in the illegal actions of the defendant," the lawsuit states.
The capital of Cetinje demands the permanent removal of the video content and demands compensation for the violation of the right of a legal entity to reputation and identity.
