Đukanović is suing the Ministry because it is silent about the complaint about the demolition of houses

The legal representative of the former President of Montenegro, Milo Đukanović, attorney Ana Đukanović, will file a lawsuit against the Ministry of Ecology, Spatial Planning and Urbanism (MEPPU) in the Administrative Court because it did not decide within the deadline provided by law on the appeal against the decision of the urban planning and construction inspector ordering the demolition of houses in Kočani. . Lawyer Đukanović announced the filing of the lawsuit in a statement for Dan.
I have not received a decision on the submitted appeal, which means that it has not been decided. The next legal remedy is a lawsuit to the Administrative Court - said Đukanović.
She added that the ministry did not make a decision within 45 days from the day she filed the complaint. Since last Friday, the department headed by Ana Novaković-Đurović has not answered our questions about the decision in this case, nor whether they will determine the responsibility of officials who did not decide on appeals, requests and emergencies in this case within the legal deadlines.
On April 25, lawyer Đukanović filed an appeal against the decision of inspector Aleksandar Todorović, who ordered the demolition of Đukanović's houses in Nikšić's Kočani settlement, and the ministry was supposed to make a decision by June 9 at the latest.
On June 9, the ministry announced that they did not decide on the requested decision on the appeal, since the deadline for making a decision on the appeal is 45 days from the date of receipt of the appeal. In the meantime, we have not received an additional response from that department, nor have the PR department responded to our calls and messages.
Urban and construction inspector Aleksandar Todorović issued a decision on April 4 ordering Đukanović to demolish two houses in the Kočani neighborhood of Nikšić within 20 days of receiving the decision because they were built contrary to the spatial and urban plan of the Municipality of Nikšić.
The inspector ordered the demolition of the houses of 170 and 89 square meters. In the meantime, Đukanović's lawyer filed an appeal against this decision, so the execution was postponed until the second-instance body of the ministry makes a decision.
The Ministry previously told Dan that, in accordance with the decision of the second-instance authority, that inspection will continue to lead the administrative procedure and undertake the necessary measures and actions.
