The Albanian Forum expresses its dissatisfaction and does not support ad-hoc procedures that have the appearance of violating the highest legal act and that threaten Montenegro's Euro agenda.
"Such procedures may bring short-term political benefit to someone, but in the long run they cannot bring good to Montenegro - not to any of its people, not to any political party, not to any citizen," said the Albanian Forum.
As it has been the practice so far that judges and the President of the Constitutional Court, due to reaching the age requirements for retirement, have their functions terminated by force of the Labor Law and not the Pension and Disability Insurance Law, they believe that such a principle should have been applied in this case as well, as it was in the case of former judge Milorad Gogić.
"But, at last night's session of the Committee, there was a lack of principle on both sides, because those who were opposed to the manner of Gogić's retirement were now in favor of its application. The application of double standards, especially at this moment, is not a good message and is not something that implies stability among the citizens of Montenegro,” the Albanian Forum emphasizes.
Therefore, the Albanian Forum considered it a better solution to elect a seventh judge before these procedures so that the Constitutional Court could function stably, and so that tensions in the parliament and the public would not rise unnecessarily.
“However, now we are where we are, so we appeal and call on the Parliament and all political actors to contribute to resolving the situation surrounding the Constitutional Court, which in the past was of crucial importance in stopping the integration process. The Albanian Forum has never, nor will it, participate in procedures that could jeopardize the constitutional order of Montenegro or distance us from the European path,” the party says.
