Djukanovic: I will not participate in the implementation of an unconstitutional law, the mandate is decided by the Assembly

Montenegro president Milo Djukanovic said he did not want to participate in the implementation of the adopted amendments to the President's Law, but that he decided to sign him because he did not want to violate his constitutional powers.

On November 1st, the Assembly adopted the Law on Amendments to the President Act. The reactions of the domestic and abroad political, professional public indicated that it was an unconstitutional initiative. This is qualified as a political intention to change the constitution as an act of lower order. I completely share such a point of view - Djukanovic said at a press conference.

He recalls that he then returned the law to re -decisive and that he had requested the opinion of the Venetian Commission.

VK gave December 9th a clear attitude and recommended that the amendments to the President be not adopted, until the Constitutional Court is completely surgery and evaluated by the constitutionality of the law - Djukanovic reminds.

“Responsibility on parliamentary majority”

The principle of superiority of the Constitution obliges, Djukanovic recalls, that it can change through procedures and most prescribed by the Constitution itself. She also recalls that the European Union's spokesman Ana Pisonero said that VK opinion should not be confessed and not voted on the amendments to this Law.

Despite all that, the Assembly re -voted the amendments to the law and submitted a day later. I am aware that in the situation of high political tensions there are different expectations of citizens to set myself up under this law. I respect and support the attitudes and emotions of citizens who express themselves through protests against the constitutional order and the state. Still, I made the decision to sign the law. I commit to the steadily respecting the Constitution, I do not want to join those who violate it - Djukanovic said.

Therefore, he notes, the responsibility for the application of this law is borne by those who voted it.

Djukanovic also announced that he would not call for consultations regarding the tanger, because he does not want to participate in the implementation of an unconstitutional law. Now, he says, most of the parliament assumes responsibility.

I do not want to join those who destroy the Constitution and the state - Djukanovic said.

According to him, the Assembly lost meaning to the decision to change the legal act of higher order (Constitution) by law (law), the Assembly lost its meaning.

With this, Parliament entered the phase of political work in which he destroys the constitutional order - said Djukanovic.

"With goodwill, you can choose the judges of the Constitutional Court"

Asked if he thought he would be able to agree on the choice of the Constitutional Court, he said he just needed goodwill.

Two sides are required to agree. It is important that on this side, by parliamentary opposition, we clearly and consistently insist on agreement. And after the government unilaterally on the Constitutional Committee established a list of candidates and gave them to declare the opposition, we told them that they had to return the process to the beginning. It is logical that you should try to reach a common point of view on the route of the authority. You saw that the government did not want it. The opposition came out with a request to the parliament to initiate a procedure for publishing ads for candidates for the Constitutional Court. With a little goodwill, it is clear that this job can be done within 30-40 days. Today, to decide to dissolve the Assembly, we have 60 days to organize extraordinary elections. There is no problem that the Constitutional Court can be chosen in a timely manner and organize the election. It just needs goodwill - Djukanovic emphasized.

Asked if he would turn to international courts, Djukanovic replied that he would use all the possibilities to protect the constitutional and legal order of Montenegro and establish the criminal responsibility of all who demolish the state.

"I listen to the opinions of the lawyer"

He said that, in terms of the possible dissolution of parliament, he carefully listens to the Constitutional Law specialists and the assemblies of steps, which he believes to show his attachment to the Constitution and the state of Montenegro in the most clear way.

No need to play with that question. I consider an unforgivable responsibility of such a violation of the Constitution. I think they do this to make it an independent Crrna mountain. That is why I interpret my obligations sidelically, so will in the event of a possible adoption of the apparition of the dissolution of parliament - Djukanovic said.

According to him, there are unique in the Democratic Party of Socialists in terms of protests "There are us."

As long as it was possible to make decisions in the institutions, I considered that time the most vulnerable. However, now that possibility no longer exists. I am glad that we have no violent demonstrations, we have citizens who gather - he stated.
