Documents reveal false announcement by Snežana Armenko

Official correspondence in the possession of Portal ETV shows that the President of the Constitutional Court of Montenegro Snežana Armenko knowingly deceived the public by stating that she had promptly and officially informed the three judges of the Constitutional Court about the request of the Constitutional Committee and her letter to the President of that parliamentary committee of the Parliament of Montenegro, Jelena Božović.

This afternoon, following a letter from three judges of the Constitutional Court, Budimir Šćepanović, Dragana Đuranović and Desanka Lopičić, Armenko made a statement claiming that the "false allegations that she submitted data on the age and seniority of judges on her own initiative or in agreement with Jelena Božović are untrue".

-The fact that such information is being presented to the public by the very same judges undersigned, protecting exclusively their personal interests and wanting to trample on constitutional norms and moral postulates of law, obviously with the aim of degrading the position of the President of the Constitutional Court - stated Armenko in her reaction.

She emphasized that the address of the President of the Constitutional Court to the President of the Constitutional Committee of the Parliament is "not unknown to these judges", while emphasizing the hope that "all legal doubts regarding this issue will be resolved both within the Constitutional Court and before the competent state bodies, exclusively in accordance with the Constitution, the applicable legal order, transparently, without sensationalist and tendentious statements".

Although Snežana Armenko states that she wants the public to be informed truthfully, without "sensationalist and tendentious statements", the letters that Portal ETV had access to prove that it was the President of the Constitutional Court who used deliberately placed deceptions and false statements.

The first letter of Jelena Božović, President of the Constitutional Committee of the Parliament of Montenegro, filed under the serial number 00-63/24-1 and dated December 10, 2024.

-For the needs of the Constitutional Committee of the Parliament of Montenegro, it is necessary to provide us with data on the date of birth, length of service, insurance years, and biographies for all judges of the Constitutional Court of Montenegro – the letter from the President of the Constitutional Committee Božović reads.

The very next day, December 11, with a letter registered under number 962/24-1, Armenko responded and submitted the “requested data to the judges of the Constitutional Court”. And the President of the Constitutional Court did all this – without convening a session of the plenum of judges, which was her legal and constitutional provision!

That she tried to deceive the public is shown by another letter – the one dated yesterday, December 16, in which Armenko emphasizes that she is submitting letters dated December 10 and 11 to the judges at their “oral request”.

So: for five full days, the President of the Constitutional Court hid the request of the President of the Constitutional Committee from three judges, while she delivered her own response to her colleagues four days late.

In addition, Armenko kept quiet about an important fact: the Constitutional Court, and not the President as an individual, informs the Constitutional Committee of the Parliament, which has never been designated as a supervisory body by the Constitution or laws, because the Constitutional Court is an institution sui generis that, according to the letter of the Constitution of Montenegro, deals with the protection of constitutionality and legality.
