DPS: A criminal complaint has been filed against Ćosović, anyone who obstructs the election process will be prosecuted

The Democratic Party of Socialists filed a criminal complaint against Aleksandar Ćosović, who on March 30, 2023, published a status on his Facebook profile calling for jeopardizing the entire election process, i.e. the upcoming second round of elections for the President of Montenegro, which will take place on Sunday. on April 2, which would simultaneously threaten the realization of the constitutional right of every citizen of Montenegro - the right to vote and to be elected, the DPS announced.
"Ćosović wrote a comment on his Facebook profile: "I thought there was an intelligent form of life among DPS officials, but it is not so. Be careful now, you invest effort, huge money, all the tycoons to organize the diaspora to come and vote. Then you stop voting at only the 50 strongest polling stations where the diaspora comes, fight in those places again next Sunday, the diaspora cannot come again and the balance of the DPS is minus a few million". It is clear that in this way Ćosović is calling for the commission of a criminal act - preventing voting by means of incitement from Article 189, and in relation to Article 24, paragraph 1 of the Criminal Code of Montenegro", say the DPS.
They emphasize that Article 189 paragraph 1 of the Criminal Code of Montenegro stipulates that whoever prevents or obstructs voting at a polling station by force, threat or other illegal means shall be punished with imprisonment for up to three years, and paragraph 2 of the same article stipulates that whoever obstructs voting by inciting disturbance at the polling station, as a result of which voting is interrupted, shall be punished by a fine or imprisonment for up to two years. At the same time, Article 24 of the same code stipulates that whoever intentionally incites another to commit a criminal offense shall be punished as if he had committed it himself.
"Having this in mind, as well as the fact that Ćosović acted with direct intent, because he must have known that in this way he was endangering the electoral process, and that this act was prohibited, we are of the opinion that there is a well-founded suspicion that he committed a criminal act. We invite the competent state prosecutor's office to carry out actions within its competence in the direction of establishing the responsibility of Ćosović. At the same time, we warn all the participants of the election process that anyone who in any way interferes with the holding of the upcoming elections will be prosecuted in the shortest possible time", concludes the DPS.
