In the draft report on the progress of Montenegro, the European Commission (EC) recommended that the Public Service must be protected from any inappropriate influence on editorial, institutional or financial independence, and that the Radio Television of Montenegro itself must fully respect the law and the highest standards of professional integrity and responsibility.
The EC also warns of the lack of transparency and possible violation of the legal procedure in the case of the re-appointment of Boris Raonic to the post of general director of RTCG, while reminding that the first-instance courts passed two judgments annulling as illegal the re-election of the general director of RTCG in June 2023, which was carried out by the Council and media houses.
- In April and May 2024, two first-instance verdicts established the illegality of the re-election of the General Director of RTCG in June 2023. Both verdicts were appealed. A preliminary criminal investigation into the case is ongoing. The Director General of RTCG resigned in July 2024, but continued to serve as Acting Director General. In August 2024, the RTCG Council re-appointed the same person to a full-time position, which raised questions about the lack of transparency and possible violation of the legal procedure - it is stated in the EC Report, Portal ETV reports.
It is added that "competent national authorities must effectively resolve any situation of possible illegality in RTCG, in accordance with national legislation and relevant international and European standards".
As Portal ETV previously announced, this month the High Court in Podgorica confirmed the first-instance decision of the Basic Court from April, which is referred to in the EC document, according to which Raonic was illegally re-elected as the general director of the Public Service, thus validly confirming that the RTCG Council did not implement previous ruling on the illegal election of Raonic from 2021.
And according to the assessment of the High Court, contrary to the allegations of the appeal, the decision on the appointment of the general director is contrary to the provisions of the Law on the National Public Broadcaster.
