Martinović: This is not a protest but a diagnosis of the situation in the judiciary; Begović: We are going through hardships since the appearance of Skaj

Several dozen lawyers gathered in front of the High Court in Podgorica, to demand that a final position be taken on the issue of the use of transcripts from the Sky application, obtained through Europol, but also to complain about the frequent refusal of bail.
Lawyer Nikola Martinović said that taking into account such a large number of lawyers, that is, the intellectual elite, this gathering is not a protest of lawyers, but a diagnosis of Montenegrin society and the state of the judiciary.
None of these lawyers who have been in the courtroom for decades are used to talking about cases in front. Today we are forced for the simple reason that our arguments, which are prescribed by law, the arguments pointed to by the Constitutional Court and pointed to by all international documents are not possible and achievable in the courtrooms of this court before which we are standing - said Martinović.
According to him, it should be pointed out that the institutes which are the guaranteed right of every defendant, namely the right to freedom, are currently not valid in the Montenegrin judiciary.
The issue of bail in the Montenegrin judiciary practically does not exist. For each case in which one of the politicians is interested or for each case in which one of the politicians is building a political career or campaign, this court does not allow bail. So you have an obvious case that in the Montenegrin judiciary they offer guarantees that are much higher in size and quality than the guarantees that are offered and accepted in Western Europe or America - said Martinović.
People, he adds, still remain in custody.
For this reason, because we cannot realize our rights to which we are entitled and protect the rights of our defendants, and the basic call of the bar is to help people who are under the influence of criminal legislation, in order to ensure the democracy of this society, we currently in accordance with the law, we are not able to do it - Martinović pointed out.
The reason is that what is prescribed in the laws is not applied in the Montenegrin courts.
For this reason, I repeat that this gathering is not a protest, but this gathering is a diagnosis of the Montenegrin judiciary - that the laws are not valid - concluded Martinović.
Lawyer Zdravko Begović said that the announcement highlighted their proposals and "the pains they are going through since the sky application appeared in these areas and the whole of Europe".
They believe that the evidence on the basis of which detentions are emphasized and determined was obtained in violation of our and international legislation, that it is, as he adds, so-called mass surveillance.
That's why we are here today, completely helpless to manage to get out of that one vicious circle that was imposed on us by chance - Begović stated, among other things.
