The decision of the Labor Inspectorate entails a legal and institutional dilemma, given that the High Court in Podgorica almost two weeks ago confirmed the decision of the Basic Court according to which Boris Raonic was illegally re-elected as the General Director of the Public Service, Nikola Obradović from the Center for civic education.
Let us remind you that the Labor Inspectorate determined after the inspection that Boris Raonic was elected in accordance with the law at the end of August as the General Director of RTCG, that this is his second term at the head of the Public Service, and that he has more than enough work experience to perform that function.
"We start from the fact that the Directorate for Inspection Affairs was abolished and we see that an environment has been created in which the labor inspection is not devoid of political influence, which immediately raises questions about the objectivity of the work of that inspection body, as well as about its role in the protection of law and justice. may call into question the correctness of future decisions, because it is difficult to believe that an inspection that operates in such an environment can act in the public interest, to be unequivocally dedicated to control, compliance with laws and other regulations on work, employment and occupational safety, both among domestic and foreign legal entities," says Obradović.
In the report of the Labor Inspectorate, it was stated that the third appointment gave Raonic a new mandate, and that the second appointment did not start a new four-year mandate, but rather a continuation of the mandate from 2021.
Obradović says that the decisions of the High Court should be final and binding, because, as he says, this leads to the question of who decides on legality in Montenegro.
"If there is no acceptance of responsibility by all the actors who consciously mock the legal system of the state, and therefore citizens, I believe that we will enter a certain type of continuity, that is, we will continue to witness further gambling with institutions and the violation of the rule of law. in this case, the question arises as to which instance in the country is in charge of non-compliance with final court rulings?", Obradović opined.
The interlocutor of Antena M believes that ultimately everyone who keeps Raonic at the head of the Public Service will bear the responsibility.
"No matter how carefree they feel, Raonic himself and the members of the Council who protect him are depriving Marijana Camović Veličković, who is leading a very important fight within that Council, surely everyone will find themselves with the price they will have to pay in the foreseeable future. a lot of work for the prosecutor's office, which behaves inertly when it comes to this entire case," says Obradović.
