Part of the RTCG employees - Srđan Čović, Tanja Šuković, Časlav Vujotić, Mladen Vukčević, Slaven Knezović and Žarko Božović - filed a criminal complaint with the Podgorica ODT against the management of the Public Service.
They appreciate that there is a basis for suspicion of corrupt behavior, abuse of official position, and violation of human and labor rights along with discrimination.
The criminal complaint was filed against: Boris Raonić, general director of RTCG, Veselin Drljević, president of the RTCG Council, Željko Mićović, head of the RTCG Legal Service, Naod Zorić, member of the RTCG Council, Filip Lazović, member of the RTCG Council, Amina Murić, member of the RTCG Council, Milica Špajak, member of the RTCG Council (acting decision) and Vladimir Drekalović, member of the RTCG Council (acting decision).
"Wanting to direct the processes in society towards civil direction, decency, professional integrity, public interest, and above all towards positive legal regulations, we have filed a criminal complaint for criminal association and abuse of office against the RTCG general director, who has been in dispute many times over the years, and those members of the RTCG Council. which serve him by enabling illegal usurpation of functions and privileges.
Through the criminal complaint, we have defined an organized nucleus that endangers the public interest while obtaining illegal material benefits, and at the same time, space has been left for the addition of names from the sphere of politics and public administration, those who, by doing or not doing, enable the unhindered operation of the group, to the detriment of morality, law and public of interest. So, the only concrete, precise, pragmatic actions of responsible professionals and aware citizens are left in an attempt to prevent such activity," says part of the employees.
"We are filing a criminal complaint for criminal association because in the long term, starting from June 2021 and the announcement of the competition for the general director of RTCG, they violated the laws, with intent, willingly and intentionally, and endangered the public interest, and enabled Boris Raonic to illegally acquire over 170 thousand EUR gross (about EUR 128 thousand net).
All these persons, in violation of the Law on the National Public Broadcaster, the Law on Labor, the Law on Salaries of Public Officials, illegally elected Boris Raonic as General Director of RTCG three times (August 6, 2021, June 1, 2023 and as Acting General Director of RTCG on July 9 2024) despite the obligations of Council members to act in accordance with their knowledge, awareness and conscience, respecting the decisions of competent courts.
In addition to tendentially interpreting the laws in favor of Boris Raonic, apparently according to a previous agreement, the mentioned persons also ignored court decisions, namely four decisions of the Basic Court (Marković and Čović cases), a decision of the High Court (Marković case - the first lawsuit), a decision of the Supreme Court (March 2024), the opinion of KAS (March 1, 2024, number 03-02-24-24-6) and the decision of the Administrative Court from February 15, 2024.
In June 2023, RTCG lawyer Mićović, not protecting the interests of RTCG, interpreted the Decision of the High Court in a tendentious and imprecise manner, encouraging the members of the Council of RTCG to re-elect Raonic, despite the Decision of the High Court.
It is particularly interesting that Raonic was present with his lawyers at the preparatory session for the second irregular election. Most of this information and accusations are known to the authorities of Montenegrin prosecutors' offices, but they delayed the initiation of proceedings (investigations) for a long time, justifying themselves by the formal reasons of the jurisdiction of the ODT or SDT. Or was it a question of the desire to subsequently create the conditions for Raonic's regularity?", they state in the application.
As they say, that became, unfortunately, clear at the moment when the amendments of the repeatedly illegal Raonic appeared as official Government amendments during the June IBAR sessions.
"Who was careless and naive, and who cooperated with Raonic, will remain for the competent authorities to judge.
From the point of view of the responsible management of a company of public interest, all principles of integrity are threatened and violated, because the services are under complete control or derogation of functions by Raonic, and it is usual:
a) Large and/or uncontrolled space for making discretionary decisions when making reassignment decisions, decisions on the variable part of earnings and other decisions of importance for the work, education, training and material status of employees;
b) Inadequate and insufficiently transparent spending of budget funds;
c) Giving preference to a specific company in the public procurement process, in such a way that the tender conditions are adjusted for a specific company.
This is particularly reflected in the several hundred changes of jobs in the Rulebook on internal systematization and organization, as well as the absence of a refined systematization table, which creates chaos in the RTCG and generates many labor-legal disputes," they add in the criminal complaint.
The largest part of these claims, they say, is found in the criminal reports - Media Centra from June 2023 and Srđan Čović from November 9, 2023.
"So you can consider this criminal report as a supplement to the existing reports. In the meantime, the Legal Service and The Council did not respond to the letters in which the person responsible for receiving and acting on notifications of suspected irregularities and fraud is drawn to the attention of Raonic's endangerment of the public interest (December 29, 2023, RTCG number 04-10561), they did not respond to the AZLP letter that , pursuant to the SPI Act, a disclosed audio recording from July 2021, which most likely contains information about who cannot be a CEO.
In addition, they refused to comment on the decisions of the Supreme Court and KAS (March 2024), probably buying time for the election of the acting president. general director of RTCG, which is also illegal because Raonic still does not have the acquired legal requirements to be the general director of RTCG.
The last illegal act was the election of the RTCG ombudsman, according to the personal preferences of the president of the RTCG Council, Veselin Drljević. The fact that Boris Raonic, at the meeting of the Council of Europe in 2010, presented himself as a law graduate, even though it is common knowledge and confirmed by the courts of Montenegro that he obtained academic status in 2018 after graduating from the Faculty of Law after 25 years, also speaks of the personal integrity of this group.
All the above-mentioned actions and circumstances testify that the above-mentioned group jointly violated the law, enabling Boris Raonic to acquire enormous funds, and that there are grounds to prosecute them for violating articles 49, 244, 244a, 272, 390, 395, 401, 401a, 416 of the Criminal Code of Montenegro. ", it is written in the report of some RTCG employees.
