Proposal of the fundamental agreement with CPC: Freedom of commissioning of religious rites in Orthodox Churches and the monasteries on the territory of the state

Representatives of the CPC, led by his holiness to the Archbishop and Mitropolitan Mihail, were to meet with the Prime Minister in the Technical Mandation of Dritan Abazovic and surrender his proposal for issues of common interest between Montenegrin Orthodox Church.

Today, the CPC announced that this meeting was canceled due to, as they say, a devastating government relationship according to the CPC and its chief.

The contract to be negotiated contains 22 members, in addition to otherwise, "State guarantees the Church of the Freedom of Liturgy, Religious Ritations and Humanitarian Activities in all Orthodox Churches and the State Territory, which are raised by funds and work Montenegrin Orthodox believers or the state's funds ... (hereinafter: the Contracting Parties)

In good will, and in order to further arrange mutual cooperation on realization:

- Constitution of guaranteed rights to freedom of religion and rights to express faith and religious beliefs;

- insurance conditions for the unobstructed and full operation of the Montenegrin Orthodox Church and its clergy with the CPC Constitution and the positive laws of the state of Montenegro;

- preservation of tradition, cultural heritage and historical heritage of the Montenegrin Orthodox Church and the believer Orthodox Montenegrins,

Article 1.

The Government of Montenegro and the Montenegrin Orthodox Church, further confirm that the state and CPC, each within its competencies, and actions will respect the separation of religious communities from the state and the freedom of faith and national commitment to the full-time Realizations of the right to freedom of religion and achievement of conditions for improving religious rights, commercial rituals and the total action of the church, its clergy and the believing people of Montenegrin.

Article 2

Article 3

Article 4

Article 5

Article 6

Article 7

The state guarantees the Church Freedom of conducting liturgy, religious rites and humanitarian activities in all Orthodox churches and monasteries in state territory, which are raised by the funds and the work of Montenegrin Orthodox believers or the state's resources.

The state guarantees the Church of Freedom of Religious Rings and other religious activities in public places, open spaces and places of events from the history of Montenegro and the Montenegrin people, in the cemetery and other church spaces, in accordance with the law.

Article 8

In the event of starting to guilty Ičnoga or misdemeanor proceedings against the CPC and Laika Clearer in the Church service, the state body that leads the proceedings will inform the competent authority of the CPC.

Article 9

The state guarantees that the secret of confession of the believer is completely and always and inviolable.

Article 10

As non-working days for Orthodox Christians in Montenegro, there are no nieces and religious holidays:

- Christmas Day January 6,

- Christmas 7 and 8 Jan,

- Good Friday,

- Easter Monday,

- Krsna fame Day.

The Contracting Parties agree that the employees will enable the Orthodox Believers in the Employer to be a one-day vacant for Krsna fame, as well as for:

- Holy Vasilia Ostroški on 12 May;

- Svetova Stefan Piperskoga June 2;

- St. Vladimir Dukljanski on June 4;

- Svetova Lvana Crnojević on July 4;

- St. Peter Cetinjskog October 31.

Article 11

The church has the right to buy, respectively, it benefits, alienates mobile and immovable goods, acquires property rights according to the provisions of the CPC, Orthodox canons and the positive laws of Montenegro.

The church has the right to establish the Foundations in accordance with the constitutional order of the state.

Article 12

The church has the right to build churches, comparing churches and monasteries and to build existing facilities, in accordance with the legal order of the state.

The competent authorities in Montenegro will not consider the decision on the construction of religious Orthodox facilities, which do not have a written approval of the non-adhesive Bishop CPC.

The state is obliged to enable the Church to participate in the preparation of spatial planning documents in order to create legal conditions for the construction of churches and monasteries.

The state is financially and materially assisted by the Church during the construction and renewal of Orthodox church facilities, especially those who have a cultural historical value for Montenegro and Orthodox Montenegrins.

Article 13

The state helps the Church about the preservation of historical values, documents, archival and other movable and immovable goods that are the historical heritage of the Montenegrin Orthodox Church, destruction, alienation, illegal presentation from the state or other illicit actions.

The assets referred to in paragraph 1 of this Article representing the cultural heritage of Montenegro cannot be alienated, nor to present from the state without the consent of the Montenegrin government.

Article 14

Restitution of goods, seized, nationalized or unauthorized to other owners without appropriate fees, will be implemented in accordance with the law that will regimilate the restitution in Montenegro, with a prior agreement with the competent church rule of the CPC.

In order to determine the real estate to be transferred to the ownership of the CPC or adequately compensate, a mixed commission will be established, composed of representatives of the Contracting Parties.

Article 15.

The Church has the right to respect, press, issues and distribute books, newspapers, magazines, audio-visual materials of spiritual, educational, cultural and scientific content in accordance with positive laws and regulations.

The Church has the right to establish radio television stations, in accordance with the positive laws of the state.

The church has access to public information.

Article 16

The Church has the right to, in accordance with the CPC Constitution, establishes religious schools for the medium and higher education of priests and religious officers

The Contracting Parties shall regulate a special contract, the issue of scholarship and schooling of Montenegrin citizens in educational institutions for the education of the CPC religious officials abroad.

The Contracting Parties shall regulate a special agreement for financial support for the establishment of the Client Educational Institutions of the Montenegrin Orthodox Church and their funding.

Article 17

The state recognizes the right of parents and an officer to religious education of their minor children.

Article 18

The state will create the conditions for the Church to achieve the right to spiritually about the Orthodox believers in the military, police, hospitals, prisons and all other health and social institutions.

Article 19

The church has the right to establish charitable and social institutions in accordance with the positive regulations of the state of Montenegro and their legal position is identical to state institutions of the same purpose.

Article 20

In order to monitor the application of this Agreement and the implementation of cooperation and more successful realization of contractual obligations and rights, the Contracting Parties agree to be educated by the Mixed Commission, which will take three representatives of both parties.

The Mixed Commission will be formed within 30 days from the day of signing the contract and meet and in need, and at least once in six months and the Contracting Parties shall report on their work.

The Mixed Commission, in case the violation of the rights referred to in Articles 3, 7 and 13, is obliged to inform the Contracting Parties immediately after knowledge.

Article 21

The contract is concluded for an indefinite period, and may be amended by the Contracting Contracting Contract.

The state and the church will address all possible disputes in the application of this Agreement.

Article 22

This contract was made in four copies in the Montenegrin language, two of which are located in the Contracting Parties.

The contract shall enter into force on the day of signing.

The contract will be published in the "Official Gazette of Montenegro" and "Lucindan” "Official Gazette of the Montenegrin Orthodox Church.
