Raonic questioned in ODT, avoided meeting with journalists

The general director of Radio and Television of Montenegro (RTCG) Boris Raonic was questioned this morning as a suspect in the Basic State Prosecutor's Office (ODT). In addition to him, in the same capacity, RTCG lawyer Zorica Đukanović and head of the legal department of the Public Service Želimir Mićović were heard.
Raonić, Đukanović and Mićović were interrogated following a report from the Media Center, because they incited the president and members of the RTCG Council to commit the criminal offense of non-execution of a legally binding and enforceable court verdict and enabled the acquisition of illegal benefits to the illegally elected General Director of RTCG Boris Raonić, thereby committing the criminal offense of incitement to the commission of the criminal offense referred to in Article 24 of the Criminal Code of Montenegro.
We remind you that on June 1, Raonic was reappointed as general director, despite the final verdict of the High Court, according to which it was ruled that he was elected illegally in August 2021 - because he was in a conflict of interest. At the time of the election, Raonic was already holding another public office - a member of the Council of the Electronic Media Agency. This was a violation of the Law on the National Public Broadcaster.
This morning, the ODT told numerous press teams, who were waiting for several hours in front of the Basic Court in Pogorica, where the suspects were interrogated, that they would make a statement.
ODT announced that B.R. Ž.M. and Z.Đ. due to the criminal offense of non-execution of a court verdict through incitement, they were heard as suspects.
In order to protect the interests of the post-regime, the Basic State Prosecutor's Office will not issue any more announcements for the time being - they pointed out from the ODT.
Journalists have been waiting in front of the Basic Court since nine o'clock this morning, in order to take a statement from Raonic after the hearing. However, even though he is the general director and manager of the largest state-owned media company, he avoided appearing in front of the journalists and in that way pointed out his relationship with the media, to which he also belongs. His reaction was not deserved by the citizens of Montenegro, who allocate around 17 million euros per year to the budget of that house. The teams were waiting in front of the two entrances of the Basic Court, to which he apparently did not go.
We remind you that on June 8, the Media Center filed criminal charges against the President and members of the RTCG Council, Veselin Drljević, Filip Lazović, Naod Zorić, Predrag Miranović, and Amina Murić, to the ODT Podgorica, because as public officials they refused to execute a final and enforceable court verdict and enabled the acquisition illegal benefits to the illegally elected director general of RTCG Boris Raonić.
On that day, reports were also filed against Boris Raonić, head of RTCG legal department Želimir Mićović and RTCG lawyer Zorica Đukanović, due to suspicion that they encouraged the president and members of the RTCG Council to commit the criminal offense of failure to execute a final and enforceable court verdict.
On June 3, the ODT also initiated a case regarding the re-appointment of Boris Raonic as general director of RTCG.
As a legal recommendation, the High Court then gave the Council two options - to announce a new competition or to choose a new director from the remaining candidates who applied in 2021.
The legal consequence of the annulment of the appointment decision is a re-selection among the applied candidates or the annulment of the competition, in which the defendant has the opportunity to reconsider the remaining applications and to make a decision in accordance with the law - the judgment reads.
However, on June 1, the Council chose not to announce a new competition, but decided again between Nikola Marković, Milutin Stijepović, Srđan Čović, and Boris Raonic, which is in direct contradiction to the judgment of the High Court, which orders that in the repeated procedure the selection can only be done from the remaining candidates.
Veselin Drljević (president), Filip Lazović, Naod Zorić, Predrag Miranović, Amina Murić took part in declaring the list of candidates. Four votes were for Raonic, and one ballot was invalid, that is, no candidate was selected.
Before the vote, the vice-president of the Council, Marijana Camović-Veličković, left the session, having previously announced that she would not participate in the decision-making if the majority in the Council, according to the suggestions of the legal service, still persisted, contrary to the court's decision, in not excluding Raonic from the list of candidates from the competition. which was announced on June 17, 2021.
She insisted that the court made it clear in its verdict what it thought about the election of Raonic in 2021 and that the issue should have been put to rest, instead of the legal interpretations of the lawyers representing RTCG in the dispute, who lost, and the legal advisor of the RTCG Council, is trying to enable Raonic to sit in the same seat again.
For the same reason, Milica Špajak, who announced during the discussion that she would not participate, was excluded from the secret ballot to participate if the prevailing attitude is to go to a vote on the appointment of a director from among the candidates, including Raonic.
The session where Raonic was re-elected was not attended by Predrag Marsenić, nor by Bojan Baća, who resigned before the session.
In the criminal complaint, it was stated that Raonić, Mićović and Đukanović committed the criminal offense of incitement to the commission of a criminal offense from Article 24 of the Criminal Code: "Whoever intentionally incites another to commit a criminal offense shall be punished as if he had committed it himself".
