The Constitutional Court revokes amendments to the Law on the President, without a decision whether Djukanovic violated the Constitution

The Constitutional Court unanimously abolished amendments to the Law on the President, which was voted by the then parliamentary majority in November, and then confirmed them in December.

It was decided on today's session.

The provisions of Article 7. paragraph 1, Article 7, paragraph 1, Article 7 of St..2, 4 and 5 and Article 24 of the Law on the President of Montenegro ("Official Gazette of Montenegro" no. 42/18 and 140/22) - Standing in the statement of the Constitutional Court.

We remind you, amendments to the President Law, which relate to the Procedure of the Mandatar for the Group of Government, adopted in December last year.

The Venice Commission recommended that the MPs that they do not adopt amendments to the law.

Article seven envisions that "President propose Mandatar after discussions with representatives of all political parties, voter groups and independent deputies represented in the Assembly."

Also, the Constitutional Court of Montenegro has not decided today whether the Council of Montenegro Milo Đukanović was injured by the Constitution. As communicated, the decision was not made because the proposal of the judge of the rapporteur for formal reasons did not receive the prescribed most of the decision.

Proposal for initiating the proceedings for determining whether Djukanovic violated the Constitution of the Parliamentary majority in December last year. In the explanation of the proposal, it was then stated that Djukanovic did not propose to the Mandatar Assembly for the composition of the new government after voting mistrust to the Government of Prime Minister Dritan Abazovic on August 20th.

As the proposal of the Rapador's judge did not receive the required majority, another judge will be determined, in accordance with the position of most judges, in accordance with Article 80 of the Constitutional Court.
