The High Court issued another verdict confirming the illegal election of Boris Raonic as General Director of RTCG on June 1, 2023, following a lawsuit by Nikola Marković.
Previously, the Basic Court also made such a decision, which the Higher Court has now confirmed.
By the judgment of the Basic Court in Podgorica P. no. 2700/23 of April 19, 2024. year, it was decided:
"The claim is APPROVED, and the decision of the defendant on the appointment of the general director of Radio and Television of Montenegro No. 01-3576 dated 01.06.2023 is annulled as illegal, and the defendant is ordered to re-appoint the general director of the defendant from among the registered candidates, according to the letters of the Public Competition for the appointment of the general director of RTCG from 17.06.2021, announced by the decision of the RTCG Council number 01-4182 from 17.06.2021, within 15 days from the date of finality of the judgment, under the threat of enforcement.
The plaintiff's claim in the part of the claim in which he requested the re-appointment of the general director among the remaining candidates, except for the candidate Boris Raonic, is rejected."
In the explanation of the High Court, it is stated that "the court does not have the authority to order the defendant to 'eliminate one of the registered candidates' during the re-election. The court only has the authority to cancel the decision of the defendant, if it was not made in accordance with the law, while the Council of the RTCG- and to make a new decision on the selection of the registered candidates, while taking into account the reasons stated by the court in the judgment by which it annulled the decision," the judgment issued on September 20 states.
Nikola Marković's lawyer, Dalibor Tomović, tells our portal that this is the fifth decision that showed that there was a conflict of interest.
"We don't expect anything from this decision, this is belated justice, but these are matters that are important for the prosecution. The bottom line is that the claim from June, when he was elected for the second time, that he was in a conflict of interest even then, and that the conflict the interest could not be removed because they made the selection through a competition from 2021. The matter was obvious when he was chosen the second time, that the law was being broken, they were breaking the law knowingly and with intent," says Tomović.
