The judges call to prevent the unconstitutional behavior of the authorities in Nikšić

Officials and sympathizers of the Liberal Party gathered today in front of the Constitutional Court building to express their protest, because that institution has not made a decision for more than a year based on the initiative of that party, which, due to unconstitutionality, demands the repeal of the article of the Statute of the Municipality of Nikšić, which stipulates that church worship declare it the Day of the Municipality.
The initiative to abolish Article 9a of the Statute of the Municipality of Nikšić was submitted to the Constitutional Court at the beginning of May last year by Jelena Martković, a member of the LP in the Nikšić parliament, who has not yet received a response.
Marković, speaking at the protest, said that the local administration in Nikšić, with the disputed Statute, regulated the secular character of Montenegro established by the Constitution in a different way and thus directly overstepped the limits of its powers.
The fact that some people do not respect the laws and the Constitution of Montenegro and abuse their official position is a matter for the Supreme State Prosecutor's Office - said Marković.
She also pointed out that the Constitutional Court should have made a decision based on her initiative a long time ago, because everything is clear in that case, as she said. The fact that, as she said, the pure case of overthrowing the Constitution is not resolved, Marković considers it a confirmation of the thesis that judges of the Constitutional Court were chosen based on their political affiliation.
She called on the reporter judge to appear before the court panel as soon as possible and prevent the unconstitutional behavior of the authorities in Nikšić.
Otherwise, unfathomable consequences may arise for the constitutional order of this country - said Marković.
She also announced that she will demand from the Parliament of Montenegro, the authorities and the opposition, if the judge-rapporteur does not react, that he be dismissed for not performing his constitutional function.
I will wait 10 days and if there is no solution to this initiative of mine, in such a way that Article 9a will be deleted from the Statute of the Municipality of Nikšić, i.e. the introduction of the glory of the city, I will schedule a protest again on April 26 and ask for your dismissal and include all the state-forming parties in it , institutions and organizations that want to preserve the constitutional order of our Montenegro - said Marković.
She added that if they do not act on the initiative and resolve the case, all judges of the Constitutional Court should be dismissed, because then, as she said, it will be obvious that Andrija Mandić has the majority in the Constitutional Court.
Marković also proposed that the Constitutional Court initiate an initiative to change the Law on the Constitutional Court, which would be harmonized with the Law on Judicial Council and Judges, which is why she called on the members of the Assembly to put the issue on the agenda as soon as possible.
Let's not allow the partyocracy to prevail in our society, because then this country has no future - warned Marković.
The leader of the Liberal Party, Vatroslav Belan, also spoke at the protest, expressing his regret over the fact that the Constitutional Court needed so much time to decide on Marković's initiative.
The secularity of Montenegro is threatened. What is the problem for the judges of the Constitutional Court to rule in a short period of time and prevent what is starting from the Municipality of Nikšić and to defend the secular character of Montenegro. Why did we choose these people when they need years to decide on the simplest issue - Belan asked himself.
