Constitutional Court of BiH Issues Temporary Measure: Unconstitutional Laws Passed by NSRS are Invalid

The Constitutional Court of Bosnia and Herzegovina, at the request of BiH Presidency member Denis Bećirović (SDP BiH), Chairman of the House of Representatives of the BiH Parliamentary Assembly Denis Zvizdić (NiP), and delegate in the House of Peoples of the BiH Parliamentary Assembly Kemal Ademović (NiP), has issued a temporary measure invalidating the unconstitutional laws adopted by the National Assembly of the Republic of Srpska (NSRS) last week.

These laws will remain invalid until the Constitutional Court of BiH makes a final decision on the matter.

It is important to note that these are the laws adopted by the NSRS, which RS President Milorad Dodik had enacted through a decree, effectively making them law. The laws prohibit the operation of the Court, Prosecutor’s Office, and High Judicial and Prosecutorial Council (VSTV) of BiH, as well as the State Investigation and Protection Agency (SIPA) in the territory of the RS, and establish the VSTV of RS.

The laws were annulled during an extraordinary session of the Constitutional Court, which was convened after the appeals of Bećirović, Ademović, and Zvizdić were received yesterday.
