The First Basic Court in Belgrade has rejected the initiative of lawyer Miroje Jovanović to deprive Serbian President Aleksandar Vučić of legal capacity, but found that the allegations in the initiative contain elements of criminal offenses whose prosecution is undertaken ex officio, an informal group of judges and prosecutors announced.
In a statement, they stated that the initiative was rejected because it was filed by an "unauthorized person" but that it is "very important" that the court found that the allegations in the initiative contain elements of criminal offenses whose prosecution is undertaken ex officio, so the case was forwarded to the jurisdiction of the First Basic Public Prosecutor's Office in Belgrade, reports N1.
"After rejecting the initiative, the court did not archive the case, but rather, considering that there were grounds for suspicion for the criminal prosecution of Serbian President Aleksandar Vučić, took the actions provided for by law and thus proved that everyone is equal before the law. It is now up to the First Basic Public Prosecutor's Office to take action in accordance with the law," the informal group "Defense of the Profession" announced.
The statement did not specify which elements of the criminal offenses were involved.
On May 5, Jovanović filed an initiative with the First Basic Court in Belgrade to initiate proceedings to "deprive" Serbian President Vučić of legal capacity.
"The 75-page document represents a serious legal and expertly-supported appeal to the court, based on concerns about the president's mental state. The initiative points to patterns of behavior that, in my belief and judgment, have elements of deep delusions, a distorted perception of reality, and a dangerous identification with the state and institutions," the lawyer stated at the time.
The case of President Vučić’s legal capacity being revoked was marked by an attack on the judge of the First Basic Court, Mina Mitić, who was assigned this case. As her friend, TV Nova presenter Marko Stepanović, said in the program, the judge was attacked in the presence of a child by a man in black, with a mask over his face, who twisted her arm and said “Stop kidding.” This attack occurred before Judge Mitić even learned about the case assigned to her.
